菲律宾海关局于2025年1月6日就实施《菲律宾‑韩国自由贸易协定》发布相关指引。该自贸协定已于2024年12月31日生效,进口韩国商品必须接受产品评核并呈交公司资料、制造流程图、成本分析和销售发票。出口商必须取得原产地证书,以确保符合原产地规则。出口商若已获颁「认可出口商」资格,可在符合既定标准的前提下,发出商品原产地声明。该指引还厘清了认可出口商的责任、完成原产地声明的程序以及验证规程。
该自贸协定生效后,预计菲律宾的热带水果更容易进入韩国市场,到了2028年1月,菲律宾出口至韩国的新鲜香蕉将可享零关税优惠。协定也有助保障菲律宾的重要产业,明确会维持敏感产品的现有关税,包括部分塑胶和石化产品、饮料、电池和电池组件、糖和糖果制品、农产品、肉制品、酱油和调味料,以及糕点制品。

BOC Issues Guidelines for Implementing the PH-KR Free Trade Agreement

The Bureau of Customs (BOC) has issued the Customs Memorandum Order (CMO) 11-2024 entitled “Guidelines on the Issuance of Proof of Origin, Granting of Preferential Tariff Treatment Under the Philippines–Korea Free Trade Agreement (PH-KR FTA)” to facilitate the implementation of Executive Order (EO) No. 80.
President Ferdinand R. Marcos Jr. recently signed EO 80, which mandates the adjustment of import duty rates on certain goods in accordance with the Philippines’ tariff commitments under the PH-KR FTA. This landmark agreement aims to strengthen trade relations between the Philippines and South Korea, enhancing economic growth and fostering regional integration.
The CMO, signed by Customs Commissioner Bienvenido Y. Rubio, took effect on December 31, 2024, coinciding with the implementation of EO 80. It includes pertinent provisions such as pre-exportation examination or product evaluation, procedures for the issuance of Certificates of Origin, application processes for obtaining “Approved Exporter” status, obligations of an “Approved Exporter,” procedures for completing an Origin Declaration, and verification protocols. These comprehensive guidelines are designed to ensure seamless compliance with the agreement and maximize the benefits of preferential trade terms.
Under EO 80, originating goods from South Korea listed in the Philippine Schedule of Tariff Commitments will be subject to reduced or zero tariff rates. These goods must meet the specified rules of origin and be accompanied by the required proof of origin to qualify for preferential treatment.
“The issuance of this Customs Memorandum Order underscores the BOC’s commitment to facilitating trade and fostering economic partnerships with our global partners. By providing clear guidelines, we aim to ensure a smooth transition and effective implementation of the Philippines–Korea Free Trade Agreement,” said Commissioner Rubio.
EO 80 and the corresponding CMO mark a significant step in the Philippines’ efforts to promote trade liberalization and regional economic integration. The BOC is actively engaging stakeholders to raise awareness and ensure compliance with the new guidelines.
