根据《财政部 国家发展改革委关于调整优化专利收费政策的通知》(财税〔2024〕23号)、《国家发展改革委 财政部关于专利权补偿期年费标准等有关事项的通知》(发改价格〔2024〕1156号),国家知识产权局自上述通知发布之日起调整部分专利收费标准和减缴政策,现将有关事项公告如下:
一、专利权人提出专利权期限补偿请求,应缴纳专利权期限补偿请求费,收费标准为每件200元。专利权期限补偿请求经审查符合期限补偿条件的,应缴纳专利权补偿期年费,收费标准为每件每年8000元,不足一年部分不收取。
二、对专利开放许可实施期间的专利年费减免15%。同时适用其他专利收费减免政策的,可以选择适用最优惠的政策,但不得重复享受。
三、通过《工业品外观设计国际注册海牙协定》进入我国的外观设计国际申请,缴纳的第一期和第二期单独指定费,可按照《财政部 国家发展改革委关于印发〈专利收费减缴办法〉的通知》(财税〔2016〕78号)、《财政部 国家发展改革委关于停征免征和调整部分行政事业性收费有关政策的通知》(财税〔2018〕37号)、《财政部 国家发展改革委关于减免部分行政事业性收费有关政策的通知》(财税〔2019〕45号)有关规定进行减缴。
四、通过批量著录项目变更请求进行申请人(或专利权人)姓名或名称变更,且不涉及权利转移的,按一件变更缴纳著录事项变更费。
五、将《国家发展改革委 财政部关于重新核发国家知识产权局行政事业性收费标准等有关问题的通知》(发改价格〔2017〕270号)附件2的注释部分修订为“由中国国家知识产权局作为受理局受理并进行国际检索的国际专利申请(PCT申请),在进入中国国家阶段时免缴申请费及申请附加费。由中国国家知识产权局作出国际检索报告或专利性国际初步报告的PCT申请,在进入中国国家阶段并提出实质审查请求时,免缴实质审查费。PCT申请进入中国国家阶段的其他收费标准依照国内部分执行。”
六、中国国家知识产权局代世界知识产权组织等机构以及其他国家和地区收取的费用,其收费标准和减缴规定按照中国国家知识产权局与上述机构、国家和地区的约定或者有关国际合约执行。

Announcement of CNIPA on Adjusting Patent Fee Standards and Remission Policies
Pursuant to the Notice of the Ministry of Finance and the National Development and Reform Commission on Adjusting and Optimizing the Patent Fee Policy (CaiShui [2024] No. 23) and the Notice of the National Development and Reform Commission and the Ministry of Finance on Matters Related to the Annual Fee Standard for the Compensation Period of Patent Rights (FaGaiJiaGe [2024] No. 1156), the China National Intellectual Property Administration (CNIPA) hereby announces the adjustment of certain patent fee standards and reduction policies as of the issuance date of the above notices. The relevant matters are set out as follows:
- A patentee filing a formal request for patent term compensation shall pay a statutory application fee of RMB 200 per instance. Upon satisfactory review confirming that the application meets all prescribed eligibility requirements, the patentee shall pay an annual fee for the compensated patent term, with the statutory rate set at RMB 8,000 per instance per year. No fee shall be charged for any period shorter than one full year.
- During the implementation period of a patent open license, a 15% reduction in annual patent fees shall apply. Where other patent fee reduction policies are also available, the patentee may select the most favorable option, but may not combine multiple reductions.
- The first and second instalments of individual designation fees for international design applications entering China through the Hague Agreement may be reduced in accordance with the relevant provisions of the Notice of the Ministry of Finance and the National Development and Reform Commission on Printing and Distributing the “Measures for Reduction of Patent Fees” (CaiShui [2016] No. 78), the Notice on Suspending, Exempting, and Adjusting Policies Related to Certain Administrative Fees (CaiShui [2018] No. 37), and the Notice on Policies for Reducing or Exempting Certain Administrative Fees (CaiShui [2019] No. 45).
- When the applicant (or patentee) requests a batch change to bibliographic data that does not involve a transfer of rights, the bibliographic change fee shall be charged as one single change.
- The annotation section of Attachment 2 to the Notice of the National Development and Reform Commission and the Ministry of Finance on Reissuing the Administrative Fees Standards of the National Intellectual Property Administration and Other Related Issues (FaGaiJiaGe [2017] No. 270) is amended to read as follows:
“International patent applications (PCT applications) received and subjected to international search by the China National Intellectual Property Administration (CNIPA) as the Receiving Office shall be exempt from the filing fee and additional filing fee upon entering the national phase in China. PCT applications for which CNIPA has issued an international search report or an international preliminary report on patentability shall be exempt from the substantive examination fee when entering the national phase and requesting substantive examination. All other fee standards for PCT applications entering the national phase in China shall comply with domestic regulations.” - Fees collected by the China National Intellectual Property Administration (CNIPA) on behalf of organizations such as the World Intellectual Property Organization (WIPO) or other countries and regions shall be subject to the fee standards and reduction policies agreed upon between CNIPA and those organizations, countries, or regions, or governed by applicable international treaties.
